Rental Terms & Conditions
The Rental Agreement is a legal contract between the landlord/hosts, Lynn and Jeff Smith, and the guest(s) for the period of time outlined in your reservation.
MODIFICATIONS - Modifications to this contract must be pre-approved in writing, at least 24 hours before check-in and agreed upon by both the Hosts and Guest(s).
USE OF PROPERTY - The use of this property is for quiet, residential short term rental use only. The hosts have made every effort to provide a safe space for the short term residential stay. Maintaining a safe property requires all guests to comply with its use and to not tamper or disable any safety mechanisms, including smoke detectors, CO detectors and fire extinguishers. Guests expressly acknowledge and agree that this Agreement is for transient occupancy of the Property, and that Tenants do not intend to make the property a residence or household.
COMMERCIAL PHOTOGRAPHY/VIDEOGRAPHY - Guest will not use the property for commercial photography/videography without prior written consent.
OCCUPANCY - Only the number of guests stated in the reservation are allowed on the property. Additional daytime guests may be allowed with prior host approval. Overnight guests that exceed the number stated in the reservation are not allowed.
SECURITY DEPOSIT - The security deposit is fully refundable as long as there are no fines, fees or replacement costs charged due to property damage or additional cleaning fees. Additional charges are described below.
LOST KEYS - Guests are responsible for replacement costs for lost keys. There is a $15 charge for replacing a lost key.
FORGOTTEN PROPERTY - If a guest’s personal property is forgotten, the host will keep the personal property for at least 7 days after check-out before discarding the items. If the guest wants the personal property mailed back to them, the guest is responsible for all shipping charges associated with the return as well as a $10 host service fee. The Host shall not be held liable for condition of said items.
PETS - Please inquire about pets prior to booking. Owners are responsible for following the Pet Rules, IF the property they are staying at allows pets. Damaged caused by pets is not covered under the Damage Waiver. Guests with service animals are allowed to stay at the property. Please notify the Host prior to your arrival if you have a service animal.
CLEANING FEE - Guests will ensure the property is left in a reasonably clean condition, similar to which you found it. The cleaning fee covers laundry, sanitation, and cleaning associated with normal use. Should there be any damage above normal wear and tear, guests will be responsible for an additional cleaning fee, up to $250. Any assessment will be completed on the same day of check-out to determine the condition of the property.
REFUNDS - We are not able to offer refunds for the following circumstances: weather-related issues, acts of God, electricity, natural gas or wireless internet outages, government actions, acts of war or terrorism, labor strikes, rioting, illness, death, or pandemic events.
INTERNET - High speed wireless internet is provided as a convenience only and is not integral to the agreement. No refund of rent shall be given for outages, content, lack of content, speed, access problems, lack of knowledge of use, or personal preferences with regard to internet service.
SAFETY - The property and front porch may be slippery when wet. The guest will use discretion when walking on outdoor surfaces and will use the handrail when walking up the porch. Guest agrees to lock the door when not on the premises and to not re-arrange the furniture. The Guest must notify the Host without delay if a fire alarm “chirps” or has a low battery condition.
PARKING - Up to two cars may be parked in the driveway. Parking in the grass is not allowed.
QUIET ENJOYMENT - The Guest shall behave in a civilized manner and shall be good neighbors respecting the rights of the surrounding property owners. The Guests shall not create noise or disturbances likely to disturb or annoy the surrounding property owners. No parties are allowed. Creating a disturbance of the above nature shall be grounds for immediate termination of this agreement and Tenants shall then immediately vacate the premises. Quiet hours are between 9:00 PM - 8:00 AM (CST) where outdoor noise should be kept to a minimum.
OPEN FLAMES - Guest agrees that open flames shall not be used inside the property.
GLITTER/CONFETTI - Guest agrees that glitter and/or confetti shall not be used inside the property. If glitter or confetti are found inside the property, the guest will be subject to a $100 fee for additional cleaning services.
HOME BIRTHS - Guest agrees to not have a home birth on the property.
FIREWORKS - Guest agrees that fireworks and other hazardous materials shall not be used in or around the property. Fireworks are illegal in Oklahoma City limits and may be subject to a fine from the Oklahoma Police Dept.
FIREARMS - Firearms are not allowed on the property.
SMOKING - Guest agrees that smoking/vaping (tobacco and/or other drugs) is not allowed inside the property. If a guest needs to smoke, they will do so at least 10 feet away from any door. No marijuana smoking is allowed, unless it’s for medicinal purposes and has been pre-approved by the host. Smoking/vaping violations are subject to a $250 fee plus the cost to clean, deodorize, and repair damages (up to $500).
ILLEGAL USE - Guest shall use the property for legal purposes only and other use, such as but not limited to, illegal drug use, abuse of any person, harboring fugitives, etc. shall cause immediate termination of this agreement with no refund of rents or deposits.
ROUTINE PROPERTY MAINTENANCE - Required maintenance, such as lawn mowing, and service appointments for electricity, plumbing, HVAC, etc. may occur during your stay. We will do our best to be as least disruptive as possible and provide ample notice.
TRASH AND RECYCLING - The Guests shall dispose of all waste material generated during the rental period.
ESSENTIALS - The hosts shall provide the following to the guests: beds, linens, pillows, bathroom linens, toiletries, kitchen supplies such as a full-size refrigerator, range/oven, dishwasher, microwave, cookware, utensils, dishes, silverware, paper towels, coffee/tea supplies, trash cans with liners, a couch, a television with access to streaming services, dining room table and chairs, and décor.
TERMINATION - The Host has the right to inspect the premises with prior notice as stated with the applicable State laws. Should the Guest violate any of the terms of this agreement, the rental period shall be terminated immediately in accordance with State law. The Guests waive all rights to process if they fail to vacate the premises upon termination of the rental period. The Guests shall vacate the premises at the expiration time and date of this agreement.
MAINTENANCE AND REPAIRS - The Guests shall maintain the premises in a good, clean, and ready to rent condition, and use the premises only in a careful and lawful manner. The guests shall leave the premises in a ready to rent condition at the expiration of the rental agreement, defined by the Landlord as being immediately habitable by the next tenants. Guests shall pay for maintenance and repairs should the premises be left in a lesser condition. The tenants agree that the Landlord shall deduct costs of said services from the security deposit prior to refund if tenants cause damage to the premises or its furnishings.
SUBLETTING - The Guests do not have the right to sublet the property.
HOST'S/LANDLORD'S LIABILITY - The Guests and Guests' Guests shall hereby indemnify and hold harmless the Host against any and all claims of personal injury or property damage or loss arising from use of the premises regardless of the nature of the accident, injury or loss. Guests expressly recognize that any insurance for property damage or loss which the Host may maintain on the property does not cover the personal property of Guests, and that Guests should purchase their own insurance for Guests and Guests' Guests if such coverage is desired.
ATTORNEY'S FEES - Guests agree to pay all reasonable costs, attorney's fees and expenses that shall be made or incurred by Hosts enforcing this agreement.
SHORTENED STAYS AND CONDITIONS - There shall be no refunds of rents due to shortened stays or ruined expectations because of weather conditions.
SHOWINGS - If the property should go on the MARKET FOR SALE, it may be shown to qualified buyers during the Guest’s stay. Every effort will be made to schedule the showing at a convenient time and not interrupt the Guest's term. Guest shall allow reasonable viewings of the home between 9 am and 8 PM whether they may be present or not.
CHARGEBACKS - If the guest disputes any fees or charges with your financial institution and the guest is found responsible, the guest will be responsible for all associated chargeback fees.
